This article analyzes the treatment given by The Council of the State of Colombia to the exclu- sive fault of the victim as grounds for exoneration of liability in direct reparation proceedings for unjust deprivation of liberty in recent years. The research, conducted by the group Conciencia Jurídica through the seedbed Ratio Iuris , aims to answer the question: what has been the treatment given by The Council of the State of Colombia to the exclusive fault of the victim in the processes of direct reparation for unjust deprivation of liberty in recent years. The men- tioned above was carried out through a quantitative-descriptive methodology that included the description, registration, quantification, analysis, and interpretation of the acquittals rela- ted to liability for unjust deprivation of liberty in recent years; finally, it was identified in which of these judgments the exoneration ground called “exclusive fault of the victim” was used.
