The migratory situation in Chile has been strained during recent years by the massive influx of foreigners. However, there has been little interest in modifying a regulation that comes from the dictatorship. It was proposed as an objective to analyze the inheritances of this one as the originalities of the migratory model established since 1975. Through an interpretative and historical analysis, different archives and legal sources were contrasted from the mid-20th century to the present, which were placed in the context of the political and social ideas of the governments and social actors referenced. Among the main results we could see the link of the legislation with nationalist, geopolitical, internal security and neoliberalism principles. It is necessary to look at the recent history of Chile to understand the pillars of the current migration policy.
