Abstract In our region, biotechnology is described as a relevant tool for two reasons: firstly, for its contribution to the commercial and economic development of MERCOSUR's States members and secondly, for the environmental challenges that it represents. Taking into account the structural framework just presented, this paper will analyze, from an inter-temporal perspective, the construction of the MERCOSUR's biotechnology policy and the role of the international Environmental Law Principles as a limit of the commercial approaches that has characterized the region. Methodologically, the article is divided in two parts. In the first one, after describing of the productive complex and the export profile of MERCOSUR's State members, the regional policy making process will be analyzed. In the second one, from a juridical and analytical perspective, the influence of the international Environmental Law Principles is observed, specifically as a vector and modeler of the regional policy. Particularly, it is examined the structural diversity of international obligations that each country has assumed. Furthermore, it is explored a possible mechanism to facilitate the construction of the regional policy. To sum up, this contribution is looking to, from a multidisciplinary view, describe the juridical and political problems in biotechnology field and pro-pose potential solutions that take into consideration environmental and commercial aspects.
