Abstract

In this paper we discuss the issue of independent candidates in Mexico, because through the so-called political reform of 2012 was incorporated in the Political Constitution of the Mexican United States the right of citizens to be registered as independent candidates. Also, in September 2013 was carried out a reform of Article 116 of the Political Constitution of the Mexican United States in order to allow independent candidates in each state of the Republic. However, prior to the constitutional reforms that incorporated such a figure in Mexican electoral law, there is a background of different types, from the legislative to the judicial. Added to this, the type of independent candidates is not unique, there are different kinds of them, for example Mexican electoral law recognizes unregistered candidates, although the votes cast for that type receive special treatment by the legislation itself. In addition, Congress has not complied with the obligation to issue secondary legislation on the matter, as the reviewing autority of the Constitution determined that statutory regulations should be issued no later than one year after the entry into force of the constitutional reform August 2012.
