On topics related to competition, the superintendence of industry and commerce have administrative and jurisdictional functions which in most of cases have been dealt by the normative. However, there are issues that have no answer, or if there are any, they are ambiguous. Therefore, the aim of this article is to analyze the scope of the administrative and jurisdictional functions that have been entrusted to the Superintendence in matters related to competition and to review the nature of its functions, its content, and the authorities responsible for complying with them, among others. Additionally, it proposes a distinction between the people who administer the law at the superintendence, and the judges who are qualified to know those processes.
