Abortion is always in debate, particularly in Spain when the Fundamental Abortion Bill was being discussed at the end of 2013. The core of the debate, as a premise of biolaw, lies with two issues. The first is whether or not the reality that exists in the mother's womb can be considered a human being from the moment of conception or, on the contrary, if it cannot be regarded as such from the beginning. In other words, can we speak of human identify from the moment of conception? The second question is whether or not an unborn human being is legally protected by the Spanish constitution and, as such, is subject to the right to life. Based on empirical data, I contend the unborn progeny is a human being and is not only alegal person protected under the constitution, as ruled by the Spain's Constitutional Court, but also enjoys the right to life. Therefore, it is necessary to amend the Spanish constitution to defend the life, health and dignity of the embryo and the human fetus from the moment of conception.
