Abstract In order to establish the relevance of the principles of good faith and free dom of form, the doctrine and jurisprudence have established certain guidelines to be taken into account in the formation of international contracts, so this article analyzes the preliminary negotiations in international contracts, studying the United Nations Convention on Contracts for the international Sale of Goods, and the unidroit Principles for international Commercial Contracts, not only appealing to the doctrinal analysis of the provisions involved, but also to the relevant cases tried by state courts and arbitration.
