Abstract This article means to bring some elements from the historic analysis to the national debate regarding precontractual liability. This is to foster a better understanding of the subject and incentivize a deeper exploration of little investigated vantage points through the scholars. So far they have received little attention due to the predominant fame of the still little comprehended theory of the German Rudolf von Jhering.
