Abstract This paper refers to the invalidity of the contract, understood as one of the remedial institutions that are applied to the contract when -since its birth presents a irregulars- can lead to curt its effects. The invalidity of the contract needs to be legally declared, for that reason, this paper contains a description of the key stages of the process of declaration of the nullity from the jurisprudence of the Corte Suprema de justicia from colombia, like a legitimization in the cause and interest to act, the possibility of accumulation with other claims, the exclusive request for compensation, the exceptions against them, their aspects most relevant of evidence, as well as the judgment and its effects.
