Abstract
FLORES RODRIGUEZ, Jesús. Surrogacy arrangements: closer to a common European legal framework. Rev. Derecho Privado [online]. 2014, n.27, pp.71-89. ISSN 0123-4366.
In Europe there are different legal regulations regarding the acknowledgment of rights of the underage kinship's condition acquired abroad through a surrogate contract. Many of those legal systems keep a strict prohibition of this contract and its effects. The lack of recognition has adverse consequences for the underage child, for his private and family life, just as the European Court of Human Rights has already evidenced. Not having acknowledged these rights of parenthood over political, civil or social matters, the underage progeny's rights can be significantly affected.
