Abstract

This study aims to examine the legal institution of the putative marriage, based on the Portuguese system. In this sense, the evolution of marriage in society and its constitution as contract will be discussed. Furthermore, we address the main aspects of this instrument, namely, the foundations of its existence, its effects on the social aggregate, which includes spouses, children and others; we intend to develop an idea of the legal relationship taking account not only of the family enclosure, but also life in society.
