This work aims to analyze the application of the original general action for contingent damages, which Andrés Bello contributed to in the Latin American Codification process. This work specifically focuses on the Chilean, Colombian and Ecuadorian model of liability based on the fact that they share the same general regulatory model: the Chilean Civil Code (promulgated on December 14, 1855, and then adopted in Colombia and Ecuador) through its consecration expressed in these countries, showing the status of their application and the dissimilar evolution among them.
