This article analyzes the Popular Legislative Initiative to regulate surrogacy In Spain. It is proposed to regulate this contractual figure guaranteeing the rights of all parties Involved In the process by bringing this feature in the figure of the notary. Therefore, this article analyzes this notarial tutelage of the surrogacy contract. It will consider whether the functions of the Notary make possible this proposal or If It would be necessary to make changes either in the draft law on notary functions well.
