With the signing of the Free Trade Agreement with the United States, Colombia acquired the obligation to incorporate statutory damages to the criteria to determinate the damage of the Ley 44 of 1993. Since it is the obligation of the government to regulate this figure which is native of American legal system, this article aims to elucidate how it could be incorporated into the traditional conception of Law of Torts in the country, fulfilling the purpose of copyright.
