The 2010 tsunami has recorded the highest number of fatalities associated with these natural disasters in South America4 in the last thirty years. Faced with such events and the subsequent death of a considerable number of people, their families sued the Chilean Treasury. I will comment the decision of the tribunal a quo5, of which the tribunal ad quem6 does not pronounce, but the tribunal of cassation does. These iudicata allude to loss of chance.
