This study analyzes the institution of residential care, in accordance with the configuration established by the Ley Orgánica 1/1996, de 15 de enero, de Protección Jurídica del Menor (LOPJM). It is intended to show that, with the latest legislative changes made in the field of protection of children and adolescents, in Spain a priority is given to foster care, dispensing in the cases of children under 6 years of judicial intervention and constituting residential care as an instrument of a subsidiary nature and, as an exceptional and provisional measure.
