Abstract

This paper tries to answer the question of the persistence in modern law of the concepts of good faith and the exception of fraud (exceptio doli), both of Roman origin. In order to achieve this objective, it inquires about the functions fulfilled by both concepts both in Roman law and in contemporary Chilean law, thus confirming, for good faith, the persistence of certain dogmatic functions fulfilled, at the time, by the exceptio doli.
