Abstract

PALACIO PUERTA, MARCELA. The Natural Factor in Appellations of Origin Granted to Handicrafts in Colombia. Rev. Derecho Privado [online]. 2023, n.45, pp.279-305.  Epub June 04, 2023. ISSN 0123-4366.  https://doi.org/10.18601/01234366.45.10.

An appellation of origin (A.O.) protects products whose characteristics are given by natural and human factors linked to the place of origin. This protection is common for agricultural and food products, and in some jurisdictions, such as the Colombian, for handicrafts. However, neither national law, jurisprudence or doctrine have established guidelines to determine the link between the natural factor and the handicrafts to obtain this type of protection. For this reason, this paper addresses this issue for the first time at the national level, based on the study of A.O. cases for handicrafts obtained in Colombia in the past.

Keywords : apellation of origin; handicraft; Colombia; natural factor; Superintendency of Industry and Commerce.
