Abstract

For years in judicial practice, particularly in ordinary civil jurisdictions, the judges have preferred to interpret and apply rights and principles, and not constitutional values in the solution of specific cases, mainly due to some difficulties of differentiation between them. This paper aims to provide civil judges, with some elements that help to clarify the close relationship between these important legal concepts and at the same time the differences existing between them. It proves that the use of constitutional values for the human rights cases solution is not an exclusive monopoly of the judges from constitutional jurisdiction.
