CACERES MALAGON, JORGE ANDREY. Do Machines Dream of Contracting? A Study on Smart Contracts and Algorithmic Consent. Rev. Derecho Privado [online]. 2024, n.46, pp.155-185. Epub 15-Feb-2024. ISSN 0123-4366. https://doi.org/10.18601/01234366.46.07.
This article introduces the reader to the characteristics and historical context in which smart contracts emerged, then classifies them and describes their impact on the general theory of contracts, for which it distinguishes between contract execution automation systems and smart contracts in the strict sense, stating that the latter require the use of artificial intelligence. This leads the research to the concept of algorithmic consent and, finally, allows us to present some conclusions about its impact on Consumer Law and the Colombian financial market.
