ABSTRACT In this article, I will briefly make comparative analysis of the experience of three countries that have made processes of transitional justice. After this outlining, I intend to show some of the problems that new democratic regimes have to deal with, such as: the form that new governments deal with the processes of transitional democracies, and the reactions of the victims and societies toward the mechanisms used by these governments. I examine the importance of democratic participation in processes of transitional justice as a way to avoid pragmatic measures and to protect the human rights of the people. I finish with some conclusions to be applied to the Colombian case.
