Competitive federalism was proposed at the end of the XX th century in the United States with the aim to devolve competences to regional and local governments. With those competences these governments would be able to take decisions, make public policy and innovate its formulation. Those elements were necessary to compete in a global economy. Nevertheless, in moments of global economic and security crisis the federal government tends to centralize power. In this context, I study in this article what is competitive federalism, and I seek to answer the question: which competitive elements survive the centralization of power. With these concepts I analyze the local legal framework in Spain. I conclude that only with the inclusion of competitive elements it is possible to equilibrate the power among the State, the regions, and the local governments.
