Abstract

FLOREZ PELAEZ, Juana. The Legal Warranty of the Colombian Consumer Law and its Coordination with Traditional Creditor's Remedies. Estud. Socio-Juríd [online]. 2023, vol.25, n.2, e03.  Epub Oct 17, 2023. ISSN 0124-0579.  https://doi.org/10.12804/revistas.urosario.edu.co/sociojuridicos/a.13003.

The Colombian legal system, like others in the same tradition, includes a series of legal actions in favor of the creditor whose interest was not satisfied with the debtor's performance. Each of these actions has different legal effects, even in cases with diverse expiration terms, whose trigger events overlap, leading to questions about compatibility (whether their exercise can be cumulative, alternative, or excluding). The consumer regulation added further complexity with the introduction of the legal warranty (Law 1480/2011), which improved consumer rights protection but also created gaps and inconsistencies within the existing legal system.

Keywords : Consumer; conformity; legal warranty; interpretation; remedies; system.
