Abstract

The article argues the existence of a minimum corpus binding for Colombian commercial companies, regarding the management of environmental, social, and governance variables (ESG criteria). We present a reading of the social and ecological function of property within the sustainable development framework adopted at the Rio Conference as a State international commitment that implies a cooperation duty for companies and differentiated tasks in its implementation. The foregoing was developed through an analysis of normative sources, national and international, as well as Colombian constitutional jurisprudence, which allowed us to conclude that the corporate purpose of Colombian corporations includes ESG variables binding by sustainable development.
