Resumen

HIGUITA JARAMILLO, Simón  y  GOMEZ RUA, Natalia Eugenia. Surrogacy: An Analysis of Regulation in some Latin American Countries. Estud. Socio-Juríd [online]. 2023, vol.25, n.2, e13.  Epub 22-Oct-2023. ISSN 0124-0579.  https://doi.org/10.12804/revistas.urosario.edu.co/sociojuridicos/a.12781.

This article studies surrogacy as one of the most popular assisted human reproduction techniques in the world and focuses on Latin America to review its regulation in Mexico, Argentina, Chile, Brazil, Ecuador, Panama, and Peru. As a main finding, none of these nations' legislative bodies have issued comprehensive regulations and the only existing lights to order this practice have been given by jurisprudence and, on some occasions, pronouncements of administrative authorities that deal with specific cases and lack the general and binding nature of the law. On the other hand, it was possible to find differences in the conceptualization, which obeys the degree of discussion existing in each country. Finally, it reflects on the absence of regulation in surrogacy and possible violations of the rights of the actors involved.

Palabras clave : Surrogacy; assisted human reproduction techniques; regulation; Latin America.
