This article presents a critical discourse analysis applied to two international human rights (HR) systems in the area of violence against women (VAW). Conventions, case law and communication materials from European and Inter-American bodies were qualitatively analysed. The results suggest a "juridification" of the responses to VAW and a repeated mobilisation of the state penal apparatus required by international bodies. This model attributes multiple functions to the criminal response, characterising its activation as due diligence. Such a paradigm overlooks the violence perpetrated by the penal apparatus itself, tends to marginalise the experiences of victims/survivors, and precludes the possibility of adopting alternative approaches, based, for example, on the framework of economic and social rights in order to respond to women's material needs. Such approaches need to be further explored in a future research agenda.
