This article developed the factors that affect the typifying process inside of a regulatory framework of "soft law" or "hard law" of the regulatory instruments issued by the National Agency of Public Procurement: Colombia Compra Eficiente, from a descriptive-analytical approach. Its prior and judicial controls together with the definition of its scope in a restrictive or broad sense demonstrate whether its non-compliance results in sanctions in fact or law.
