In this article the main objective is determinate the characteristics of constitutional monitoring applied to sub-rules incorporated into the judgments issued by the judges in exercise of the functional competence. Moreover, It was taken a quantitative methodological approach under a bibliographic design documentary in a historical level. representing the different positions in the Constitutional Court and the application of a diffuse constitutional control as monitoring of the legitimacy in the deviation of sub-rules by instance judges. Theoretical and methodological contribution to execute a diffuse constitutional control.
