This essay is a critical analysis of the social and legal reality shared in most Latin American countries, from the perspective of a concept and literary trend as is the magical realism and a philosophical approach represented in the legal realism. The mixture and satire of both concepts gives rise to a new construct: the legal magical realism, which in essence represents the critique of daily separation of normative reality and social reality
