This article takes the central idea of defending the fundamental rights of the LGBTI community in Colombia, starting from the principialist theory in the construction of modern constitutionalism, in compliance with the founding principles of the rule of law, as gestation Colombian real constitutional state. The theoretical construction of the entire document, mainly exhibited in key for the recognition of these rights, in the conception of new subjects of special constitutional protection. The main topics to be developed in the documents that are set forth below: (i) The recognition of the theory of constitutional principles in dimension. (ii) Principialist rights in the creation of the Colombian constitutional state. (iii) The constitutional policy that excludes the family union of same-sex couples against the right of equality of heterosexual couples
