Abstract

This article will develop one of the forms of liability for damages that may be incurred by the State, named for some responsibility for the fact of the laws or also known by others as the responsibility of the State legislator. It will be approached starting from its formation and historical consolidation in the comparative jurisprudence, especially the French and Spanish, following the essential criteria that give rise to its configuration, according to whether the laws were subject of an inexequilidad or without being declaratory made, in any case the standard derives the production of an injury.
