Abstract
ILLERA LOBO, Mercedes Leonor and CONTRERAS SILVA, Erika Jazmin. Colombian children, victim of explosive devices. Justicia [online]. 2018, n.33, pp.224-238. ISSN 0124-7441. https://doi.org/10.17081/just.23.33.2890.
This article of scientific research analyzes the problem of improvised explosive devices and the damage caused to children as victims of them, which implies making inquiries in relation to case law and protection measures adopted by the Colombian legal system and the international normative framework. Therefore, the present study evidences results from a hermeneutical method, with the application of a documentary study with a qualitative design, bearing in mind the jurisprudential analysis carried out and the reparation to the minor victims of the Colombian armed conflict in light of the 1448 Law of 2011 and its Regulatory Decree 4800 of the same year. However, this article in its conclusions shows the systematic violation of fundamental rights for the Colombian children, because despite the development of demining, it is not yet possible to determine exactly the number of explosive devices planted throughout Colombian territory, which causes constant uncertainty in the population, and implies the omission of the Political Constitution.
