The present article of investigation reveals the way in which the Supreme Court of Justice, Criminal Chamber of our Country, has been studying the principle of congruence and its extension, to the imputation hearing, delimiting in what aspects it should keep consistency the issuance of the sentence even from the imputation hearing, taking into account that within the so-called accusatory system, which has its roots in the North American system, this hearing does not stand as substantial in the implementation of this procedural system. In this way, the work aims to expose the normative approaches and line of jurisprudence that the Supreme Court of Justice has been developing through the enforcement of Law 906 of 2004.
