Abstract

This article focuses on analyzing the international standards that protect the labor rights of migrants in an irregular situation. A significant increase in this phenomenon has been observed in recent years, which has generated an international policy in this regard. A methodology was used that included documentary review with a qualitative approach. It is important to note that all individuals have fundamental rights and freedoms recognized by universal instruments, such as the Universal Declaration of Human Rights. The Inter-American Court has established that the labor rights of migrants are based on the rights inherent to their status as workers and on human dignity. In South America, safe migration is promoted, and decent work and inclusive markets are promoted.
