Abstract

The rule of "privacy or intimacy" is one of the bioethics' rules. It must be respected but there are many cases where health professionals are faced with dilemmatic situations about this rule. We elucidate the concept of privacy and show its relationship to health care. We approach the issue from the perspective of Principlism and from the legal framework in Argentina. Finally, we show relationship between this rule and medicine. We conclude that all the information about a person falls within the scope of his privacy; prima facie, no one has the right to access it without consent. Though in certain situations related to health attention, this right yield in pursuit of the common good, this should be the exception and never the rule. On the contrary, in the area of the research the scale inclines towards the preservation of the individual rights.
