Prosecution is the result of the complexity of human life in the political, economic and social environment, with the commitment of various stakeholders, from different perceptions and perspectives in the concept of a micro justice dispute, which means that from the beginning of the conflict, its management, and outcome, mobilizing both the health system and the justice system, for the production of care to the citizen. The purpose of this article is to investigate this idea of care from the point of view of the representatives of the law, the executive and the citizens, to understand the dynamics between life policy and policy on life, biopower, within the framework of judicialization of medicines in the state of Rio de Janeiro, Brazil. The methodology used in the research considers the qualitative approach integrated with the analysis of the rhetoric of the interviewees' narrative. Finally, based on the processual arguments and narrative of the participants in the research, it is possible to identify different ethical parameters that are present in both the process arguments and also on the daily action of participants, guide decision-making; and reflect on how such parameters operate as life power or death power for a care ethic.
