In contemporary constitutionalism, it is often said that constitutional interpre tation is special with respect to ordinary legal interpretation. One of the reasons for this thesis is based on the properties attributed to the constitution. The pur pose of this text is to reconstruct the background of the thesis on the special in terpretation of the constitution in the constitutional state. In general terms, I argue that the background of the thesis weakens its interpretative nature. The specialty of constitutional interpretation can be understood as a reaction to the democratic objection against judicial control of constitutionality.
