This article aims to identify the meeting points in industrial property based on the rights conferred by invention patents and state contracting as an administrative action established for the management of governmental purposes. Such a relationship is in the general interest, since the protection of industrial property must not only be reputed by the holder of rights, but also for the benefit of society, which is identified in the different limitations to the exercise of patent privileges. The latter is one of the objectives of public procurement systems, an aspect that should be examined in the field of direct contracting, either due to the absence of plurality of bidders or to the conclusion of contracts whose purpose is related to the development of science and technology.
