Abstract

MADRID BERROTERAN, Luis Ángel. Exhaustion of intellectual property rights and parallel imports of pharmaceutical products: The Colombian case. Civilizar [online]. 2022, vol.22, n.43, e20220208.  Epub Feb 17, 2023. ISSN 1657-8953.  https://doi.org/10.22518/jour.ccsh/20220208.

This paper examines the exhaustion of intellectual property rights in the Colombian pharmaceutical sector and the absence of parallel imports of pharmaceutical products in the country. This situation occurs despite the adoption of international exhaustion of rights by the Andean Community and the issuance of Decree 1313 of 2010, which establishes the requirements and procedures to authorize parallel imports of pharmaceutical products and medical devices. For the purpose of offering a comparative analysis, the European experience in the matter is also studied in this work.
