Abstract

Juridical concept of pain according to constitutional law has been described in only one perspective: acknowledgement of the basic right to live in dignified conditions. The right to life has been affected by incidental questions: when pain does not allow having a balanced life in all aspects, it allows constitutional protection to life. It is understood that body is a fundamental element in a theory on a dignified life; a body under suffering and sick is a body limited and conditioned to aspects such as psychological ones. The right to health, pain, and basic right to life are related, while surgical procedures, supply of medications, all kind of treatments to relief pain or to totally get rid of it have been the reasons why Colombian Constitutional Court has talked about pain, a topic which has involved family violence, punishment to children, pain management by communication media, euthanasia, and disthanasia.
