Abstract

RUBIANO MUNOZ, Rafael. Law and Politics Miguel Antonio Caro and regeneration in Colombia by the end of the XIX century. Opin. jurid. [online]. 2007, vol.6, n.12, pp.141-162. ISSN 1692-2530.

Relation between law and politics in Miguel Antonio Caro's conservative thinking is one of the analytical references which can explain several ways of violence which have survived for over a century in our territory. In Caro's opinion, law and politics are power instruments available to organize and structure society in a unique sense and in a unique direction. For this intellectual patrician with a strong conservative thinking, they are useful as instruments to homogenize, uniform, and oppose plurality in societies. Society's order is more important than any demand for freedom. Consequently, when ideological debate is powered and intolerance is increased, a society in a continuous conflict against dissidence, confrontation, and controversy arises, so political opposition as a warranty to acknowledge rights of minorities and opinions should be annihilated, censored, and, of course, extirpated.

Keywords : Conservatism; regeneration; moral authority; religiosity; law and power.
