This thesis proposes a change of rationality to deal with the conciliation as they are needed, in practice it is deprived of the potentiality of solving extrajudicial conflicts. The parties involved participate in the conciliation meeting to fulfill the legal requisite of procedure and later be able to recur to the ordinary justice. The change of rationality proposes consists in a theoretical reflection oriented to presume conciliation as a true dialogue space, of mutual understanding, that is, to deal with it from the perspective of communicative rationality.
