This paper addresses some considerations about the free software, their opportunities but also its challenges, while sets out the legal framework for this figure since its implementation in Venezuela. It has used a methodology narrative - explanatory, based on the review and bibliographic in conjunction with national legislation on the subject. It was also consult FUNDACITE ZULIA, through the Mission Science. Concluded that free software is an opportunity to develop programs that address particular needs, and there are those who believe it is a particularly useful tool to democratize access to information in developing countries, however, raised the realities of a digital divide between in developing countries and developing countries.
