Abstract

VAZQUEZ PEREZ, Arsul José. The cur debetur: Essential element of a contract?. Opin. jurid. [online]. 2008, vol.7, n.14, pp. 115-130. ISSN 1692-2530.

From an integral perspective, the main theoretical propositions which have been made in relation to contracts have been assessed by the most important creators. Periods taken are those from the Roman Law to the last theory that on Reasons for Contracts has had relevance and normative and jurisprudential application. With a new approach of the problem, the author achieves a belligerent result to old ideas and outlines postulates of a new conception in relation to the cause in this kind of juridical cases. Although it is a critical position to prevailing conceptions about this topic, the author's criterion makes use of the best out of prior conceptions and in a certain way contributes to the improvement of the notion of cause in Contracts Law.

Keywords : Contract; essential elements; cause.
