The environmental issue has assumed great importance in todays society. The overuse of resources is the basis for great discussions. While it is recognized that every citizen has the right to enjoy the environment that surrounds them, there are imposed duties in order to assure the rational use of environmental resources. Despite the existence of a comprehensive environmental legislation, the issue requires greater control mechanisms in order to guarantee the protection of natural resources. Then, a new interpretation of the procedural principles that invigorate in the order, in the direction becomes necessary to improve the guardianship of the environmental.
