Abstract

In this paper we explore the possibilities of taking advantage of certain theses of Popper's epistemology to articulate a teaching-learning proposal intended to improve both processes in law schools. We will argue that unconstitutionality rulings of the Constitutional Court are a special case of the use of Popper's principle of falsifiability and that it is possible to move the central notions of his epistemology to didactics and pedagogy. In the central part of the article, we suggest to take advantage of the principle of critical epistemology in action, which is implicit in some unconstitutionality rulings of the Constitutional Court (1993-2000 period), to introduce changes that promote a critical attitude in Law Schools' students
