Abstract

SOTO OBREGON, Martha Elena  and  RUIZ CANIZALES, Raúl. Doctrinal Management of Conscientious Objection and Civil Disobedience in Ronald Dworkin and Jürgen Habermas. Opin. jurid. [online]. 2013, vol.12, n.23, pp.151-166. ISSN 1692-2530.

Conscientious Objection (CO) and Civil Disobedience (CD) entities have been studied by several authors, but most of them have always resorted to the same theoretical references: ''frontier authors'' who study such entities in a tangential manner based on their fundamental theses, and make of them mandatory references (classics) for future researches. This is a typical situation of the saturation principle application. The objective of this article is to take one of these frontier authors (Ronald Dworkin and Jürgen Habermas) in order to perform a deeper analysis on the structure of CO and CD, discuss with the author the application of his premises.

Keywords : Conscientious objection; civil disobedience; doctrinal analysis; conceptual analysis.
