The main point of this article to demonstrate, from the notions of environment and contract protection -especially reflated to positive Colombian Law, that the main exiting theories in contract law, in a way or the other, have made important contributions related to ecological implications of a contract, but that no one has had this as its main object of study; therefore, it is necessary, in order to study the protection of the environment in mercantile contracts Colombia, to resort to a theory different from the contract law.
