This article investigates the construction of the social space occupied by children or adolescents who have been excluded or deemed "dangerous". A key historical period for this construction is analyzed by the author along with the period that preceded the formation of the first tribunal for the social and punitive control of children. This literature review is focused on the area of childhood and how it is perceived from diverse disciplines (sociology, education, psychology and law) to offer as comprehensive a perspective as possible. From this analysis we shall deduce how these tribunals, which have the goal of supporting the wellbeing of the most vulnerable of children, on the contrary contribute to the deepening of these children’ s stigmatization and the negation of their basic rights.
