In school life there are struggles between students and teachers that can move from the classroom to the courtroom. This article analyses these legal battles, their content and what they have achieved. The authors conducted a qualitative documentary review of 80 Constitutional Court Orders from 1994 to 2016 about rights that had been violated at schools. Drawing on Bourdieu’s theoretical, we identified resistance in the school field against the recognition of children as subjects of rights. The rights violated included due process, free development of personality and the right to education.
